Legal Guide
The legal basis, who actually needs one, and how to get yours issued without the common setup problems.
A digital certificate is the credential, a file issued by a licensed Certifying Authority that cryptographically proves who you are. A digital signature is what you create when you use that certificate to sign something, a mathematically verifiable mark that ties the document to your identity and proves it hasn't been altered since. The certificate is the "who," the signature is the "what happened."
This distinction is what actually makes the signature legally binding, it's not the act of clicking "sign," it's the fact that the signature is cryptographically traceable back to a certificate whose issuance was independently verified.
The Information Technology Act, 2000 gives electronic signatures the same legal standing as handwritten ones, provided they meet specific conditions. A Class 3 DSC satisfies these because it's issued only by a Certifying Authority licensed by the CCA (Controller of Certifying Authorities), following strict identity verification, currently Aadhaar-based eKYC.
This is why courts, government departments, and portals like MCA and GST treat a DSC-signed document as authentic and non-repudiable, the signer can't later claim they didn't sign it, because the cryptographic trail proves otherwise.
Signing audit reports, filing on behalf of clients across MCA, GST and Income Tax, where the certificate legally attributes the filing to you specifically.
Annual filings, Director KYC, board resolutions, an Organization DSC ties both your identity and the company's to every document you sign.
ICEGATE and DGFT filings require a Combo DSC, since customs documentation needs both signing and encryption for legal validity.

The process is fully paperless: Aadhaar-based video eKYC verifies your identity in minutes, the licensed CA issues your certificate the same day in most cases, and it's loaded onto a FIPS-compliant USB token dispatched to your address. It then works across MCA, GST, Income Tax and ICEGATE without any separate registration per portal beyond the initial setup.
See the full step-by-step process →Usually a missing or outdated driver. Reinstall the manufacturer's driver for your specific token model, then reconnect it, most detection issues resolve here.
Some portals still rely on Java applets or specific browser plugins for signing. Chrome and Edge generally work best for modern portals, older MCA-style flows sometimes need Internet Explorer mode or a dedicated signer utility.
Often a missing intermediate CA certificate in your browser's trust store, or an outdated emBridge/token middleware. Reinstalling the token's middleware software usually resolves this.
Check whether that portal specifically requires Combo DSC rather than Signing only, ICEGATE and GeM are common culprits here.
The old process meant physical documents and courier turnaround. Aadhaar eKYC removes both.
If you're against a deadline, a same-day DSC can be the difference between filing on time and missing it.

It can be questioned like any evidence, but a Class 3 DSC signature is difficult to repudiate, since it's cryptographically tied to an identity verified by a CCA-licensed CA, courts generally treat this as strong evidence of authenticity under the IT Act.
Yes, Aadhaar e-Sign is also legally recognized, but it's a different mechanism, generated per-transaction rather than tied to a certificate you hold. Companies and several portal filings specifically require a DSC rather than e-Sign.
Yes, your own Individual DSC can sign filings on behalf of multiple clients where you're the authorized signatory or preparer, it's tied to your identity, not a specific client.
Some older portal signing tools were built Windows-only. Most modern tokens and portals support Mac now, but check your specific token's driver page, and use Chrome or Safari with the correct middleware installed.
Not usually, Class 3 DSC validity for MCA, GST, Income Tax and ICEGATE filings is well-established and standard. If you have a genuinely unusual legal question specific to your situation, that's worth a lawyer's opinion, but routine filings don't need one.
